Mediation Fee Rates

Mediation expenses are billed equally to the parties for the rates listed above. Invoicing will be split equally among the parties unless otherwise agreed to in writing by the parties. Invoicing will be for the total time spent on the dispute, except as otherwise noted below. 

• Mr. Bennett does not conduct mediation at his office. Most mediations will be held via video c 
• Mediation conferences requiring rented facilities will be billed equally to the parties and included in final invoicing.
• Mr. Bennett does not charge travel time for in-person mediation conducted in the following counties:  Manatee, Sarasota, Pinellas, Hillsborough, Pasco, Polk, Hardee, or De Soto. In-person mediation conducted outside this region will have an additional charge. *Contact us for details. 

• Mr. Bennett accepts engagements to the exclusion of other work during the reserved period. As such, the following applies to all matters.
• Cancellations within 10 days of the scheduled conference will incur a minimum charge of 2 hours for half-day reservation and 4 hours for full-day reservation. Unless otherwise agreed in writing, all parties and their attorneys are equally responsible for any cancellation fee.
• All cancellations must be agreed to by each party and communicated in writing.

• Payment for mediation fees and expenses must be received by the office within fifteen (15) days of receipt of billing for the mediation services. Payment may be made by check, Visa, MasterCard, American Express, or Discover.

• Attorneys representing parties in the matter, or their law firms, are responsible to ensure that the Mediator is paid in a timely fashion, and, if not, the attorney or law firm will become personally liable for said fees and costs, including cancellation fees.   

• Pro se parties (no attorney) must pay by check, Visa, MasterCard, American Express, or Discover at the conclusion of the mediation conference. An advanced deposit or credit card authorization is required to secure payment by pro se parties.

• Invoices are generally emailed after the conclusion of the mediation conference. However, Bennett Mediation reserves the right, in its discretion, to require an advance deposit or credit card authorization. Failure to pay any required advance deposit by either party ten (10) days prior to the mediation conference will result in cancellation of the mediation. Written notification of the requirement of an advance deposit will be provided after scheduling.

• We do not generate mediation notices but will need a copy. Please make sure to email us a copy upon scheduling.

• Pre-mediation summaries or other materials are strongly encouraged. Summaries of 7 or fewer pages will be reviewed at no additional costs. Otherwise, material review will be billed at the above rates and divided equally among the participants.  Please email all per-mediation materials at least 48 hours prior to your mediation conference.
